Senators to hear Trump judicial nominees with records of advancing draconian abortion bans

Washington D.C. – Tomorrow, the Senate Judiciary Committee will begin hearings for President Donald Trump’s initial slate of judicial nominations, as he reignites his campaign to capture to courts at every level. Trump’s first judicial picks have a dangerous record of undermining fundamental freedoms, with a number of them who have a record of directly targeting reproductive rights. Today, Accountable.US is releasing a report detailing the alarming red flags among Trump’s judicial nominees and their record of limiting Americans’ ability to make their own health care decisions. 

“Donald Trump is picking up where he left off in his first term by using judicial nominees to advance an extreme agenda that undermines Americans’ fundamental freedoms,” said Accountable.US President Caroline Ciccone. “But this time, Trump is selecting nominees with personal allegiances to the President, who will go even further in using the bench to cut off Americans’ rights. Senators should know a vote to confirm Trump’s judicial nominees is a vote to radically undermine reproductive freedom.”

  • Whitney Hermandorfer, nominee to the 6th U.S. Circuit Court of Appeals: Trump nominated Whitney Hermandorfer, director of strategic litigation for the Tennessee Attorney General’s office, to the Sixth Circuit Court of Appeals. She has vehemently defended Tennessee’s near-total ban on abortion, including unsuccessfully seeking to dismiss a lawsuit from doctors seeking clarification on exemptions. Hermandorfer also defended the state after the Biden administration revoked Title X funding for refusing to counsel patients about abortion health care.

  • Joshua Divine, nominee to the U.S. District Court for the Eastern District of Missouri and Western District of Missouri: Trump nominated Joshua Divine, solicitor general of Missouri, to the U.S. District Court for the Eastern District of Missouri and Western District of Missouri. Divine has defended Missouri’s extreme anti-abortion laws, even after voters approved a reproductive rights ballot measure, and pushed to even further restrict reproductive health care access. He signed onto Missouri’s effort to intervene in the judge-shopped lawsuit to reverse FDA approval of mifepristone, which even the Trump administration asked to be thrown out. The state’s complaint alleged that fewer teen pregnancies hurt the state financially. He also defended the state’s burdensome requirements to access abortion care, including mandatory waiting periods, ultrasounds, and pelvic exams, in a lawsuit from Planned Parenthood, and defended the state’s move to block the clinic from receiving Medicaid reimbursements.

  • Maria Lanahan, nominee to U.S. District Court for the Eastern District of Missouri: Trump nominated Maria Lanahan, principal deputy solicitor general of Missouri, to the U.S. District Court for the Eastern District of Missouri. Lanahan supported Missouri’s effort to intervene in the FDA mifepristone case, defended Missouri’s abortion ban against a challenge from religious leaders, and argued that Missouri should not have to pay Planned Parenthood’s legal fees after a failed attempt to restrict their abortion provider license.
